Adjournment in Contemplation of Dismissal
New York law provides for the dismissal of certain cases through what is called
an adjournment in contemplation of dismissal (ACD). An ACD is an adjournment
in the interest of justice with a view to dismiss the case. The granting
of an ACD is not a conviction and is not an admission of guilt. The court
may, as a condition of the ACD, require the defendant to perform community service
or participate in a program. For cases involving marijuana charges or a family
offense, the length of the adjournment is one year; for all other cases the adjournment
is for six months.
