Sexual Abuse

There are three degrees of Sexual Abuse. The degree is determined by elements such as whether force is used, the nature of the incapacity to consent, and the ages of the victim and the defendant.

Subjecting someone to sexual contact without consent.

Subjecting someone to sexual contact who is:

  • Who is incapable to consent for some reason other than being less than 17 years old, or
  • Less than 14 years old.

Subjecting someone to sexual contact:

  • By forcible compulsion,
  • Who is incapable of consent due to being physically helpless, or
  • Who is less than 11 years old.

Aggravated Sexual Abuse

There are four degrees of Aggravated Sexual Abuse. The degree is determined by elements such as whether force is used, whether a finger or foreign object is used, the nature of the incapacity to consent, and the age of the victim.

Inserting, other than for a valid medical purpose, a foreign object or finger in the vagina, urethra, penis or rectum of someone who is incapable of consent for some reason other than being less than 17 years old.

Inserting, other than for a valid medical purpose, a foreign object in the vagina, urethra, penis or rectum of someone:

  • By forcible compulsion,
  • Who is incapable of consent due to being physically helpless,
  • Who is less than 11 years old, or
  • Incapable of consent due to being mentally disabled or incapacitated and causes physical injury.

Causing physical injury by inserting, other than for a valid medical purpose, a finger in the vagina, urethra, penis or rectum of someone:

  • By forcible compulsion,
  • Who is incapable of consent due to being physically helpless, or
  • Who is less than 11 years old.

Causing physical injury by inserting, other than for a valid medical purpose, a foreign object in the vagina, urethra, penis or rectum of someone:

  • By forcible compulsion,
  • Who is incapable of consent due to being physically helpless, or
  • Who is less than 11 years old.
